Fencing Policy

EFFECTIVE MAY 5, 2004

All fence requests must be approved by the Board of Trustees of Newport Landing in writing prior to installation.

All letters must indicate the type of fence to be installed (with a detailed drawing on the plot plan) and dotted lines showing where the fence will be installed per the attached sample spot survey drawing.

The following guidelines will be followed for all fence approvals:

1. Maximum height of 48" for full perimeter fencing.

2. Fencing must be full perimeter, with the exception of corner lots where fencing must not be erected beyond the building line of the adjacent street.  No fencing shall be erected or maintained on any Lot between the rear of the residence constructed upon such Lot and the street upon which such Lot fronts.  Fencing must start at the rear corners of the residence. Fencing must be within four inches (4") of the Lot lines and Lot corners.  Lots may have exceptions at the sole discretion of the Trustees of Newport Landing.

3. Cedar or Wolmanized (treated wood) board fencing may have any picket width up to a maximum of six inches (6") in width.  The minimum open space between pickets must be three inches (3") regardless of the picket width.

4. All fencing will be either/or:

Wrought iron or aluminum simulated wrought iron

Picket style

5. All fencing to be made only of the following materials:

Wrought iron or aluminum simulated wrought iron

Cedar or Wolmanized (treated wood)

White vinyl fencing

6. All picket fences to be installed with the good side facing out.

7. It is recommended that Lots be professionally surveyed to assure proper fence locations.

8. Dog runs will not be permitted.

9. All wood fences are to remain in their natural state; that is, they can not be painted a color.

10. Swimming pool and patio privacy fencing will be handled on a case-by-case basis.  Requests must be made in writing as stated above.
